(CNSNews.com) -- The Justice Department is not saying whether Solicitor General Elena Kagan has been taking the full federal salary of solicitor general since she “ceased” performing the full responsibilities of that position more than two months ago.

On July 13, all seven Republicans on the Senate Judiciary Committee sent a letter to Kagan asking her to respond to certain questions for the record.

The Justice Department could file a lawsuit challenging Arizona's immigration law as early as Tuesday, an official tells Fox News.

The potential court action comes just days after President Obama delivered a speech calling on Congress to tackle a comprehensive overhaul of the nation's immigration system. In the speech, he criticized Arizona's law and warned that national legislation is needed to prevent other states from following suit.

The president did not mention the lawsuit, but one was widely expected. After the administration initially said it would take the law under review, Secretary of State Hillary Clinton revealed last month in an interview with a foreign television network that the administration intended to challenge the Arizona policy. The Justice Department would do so on the grounds that federal responsibility for border enforcement preempts any state law on the issue...

The Justice Department is preparing to sue Arizona over its new immigration law. The president has stiffed Gov. Jan Brewer's call for meaningful assistance in efforts to secure the border. And the White House has accused Arizona's junior senator, Republican Jon Kyl, of lying about an Oval Office discussion with the president over comprehensive immigration reform. Put them all together, and you have an ugly state of affairs that's getting uglier by the day...

House Republicans on the Judiciary Committee are demanding that the Justice Department turn over documents on the White House's attempts to lure Democratic candidates out of Senate races with job offers.

Republicans filed a resolution of inquiry Thursday night seeking to uncover whether Justice attorneys were consulted about the legality of the White House making offers to Rep. Joe Sestak, D-Pa., and Andrew Romanoff.

Once a resolution of inquiry is introduced, the committee has 14 legislative days to consider it. Democrats on the committee have indicated that they may take it up as early as next Wednesday, a GOP committee aide said...

(CNSNews.com) - The U.S. Justice Department gave a group called the New York Agency for Community Affairs a grant of $135,130 in fiscal year 2005 to “provide youth leadership training to students at select New York City schools, form ‘ACORN Youth Union’ chapters, and coordinate student campaigns to address issues such as school funding, neighborhood safety, and school governance,” according to a Government Accountability Office report released this week.

The GAO report says that in fiscal years 2005 through 2009 the federal government gave ACORN and what the GAO calls “potentially related organizations” more than $40 million in federal funds.

(CNSNews.com) – After a conservative group posted a video on Tuesday calling for the Department of Justice to release the names of department lawyers who previously worked in the private sector representing or advocating on behalf of terrorist detainees, a DOJ spokesman responded with a statement that still does not name the attorneys.

“As we noted in a letter to senators, the Justice Department's attorneys are subject to ethics and disclosure rules as required under both department guidelines and this administration’s own ethics rules, which are the strongest in history,” said a statement from Matthew Miller, spokesman for the DOJ.

“One week after this department secured a guilty plea from Najibullah Zazi for attempting to attack the New York subway system and indicted two of his co-conspirators for their alleged role in that attack, it should be clear that fighting terrorism and keeping the American people safe is our number one priority,” Miller’s statement sai

Washington (CNSNews.com) – White House Press Secretary Robert Gibbs said he did not “have the timeline” and therefore did not know at Thursday's press briefing whether President Barack Obama knew in advance on Christmas Day that Miranda rights were going to be read that day to Umar Farouk Abdulmutallab, the terrorist who tried to detonate a bomb on Northwest Flight 253.

Gibbs, however, said he would check to find out. "I'll go back and look at the timeline," he said.

FBI agents told Abdulmutallab he had the right to remain silent and consult a lawyer only about ten hours after he was arrested. Up until that point, the terrorist had only been interrogated for about 50 minutes. After he was Mirandized, Abdulmutallab initially stopped talking to federal investigators.

Washington, DC (LifeNews.com) -- The Senate Judiciary Committee has again postponed a vote on pro-abortion Obama nominee Dawn Johnsen. The panel was slated to vote on her nomination today after considering two other nominees but it lost a quorum to do business just before her nomination was slated to be considered.

Johnson's nomination was already delayed one week but was held over until today.

The delay gave pro-life advocates more time to focus on opposing her nomination to the key Justice Department post.
